Motion by Tidball, seconded by Gregerson, to approve the May 22, 2008, Commission Meeting Minutes. Motion carried (all ayes).

Laurie Gustafson, Labor Law Compliance Officer, brought before the Commission the US Dept of Labor’s Davis-Bacon Wage Rates will be in Future SDDOT Federal-aid Construction Contracts. A request for consideration of the Commission to adopt the DOL's Wage Decisions to apply to SDDOT's future State-funded construction contracts that are awarded for $100,000 or more.
Motion by Kranz, seconded by Fouberg, to approve the Dept of Labor’s Davis-Bacon Wage Rates apply to Future SDDOT State-funded Construction Contracts that are awarded for $100,000 or more. Motion carried (all ayes).

Bill Nevin, Legal Counsel, presented information regarding proposed changes for the following speed zone rules; 70:01:02:18(2) Clark County and 70:01:02:49(3) Meade County. This is the time and place set for public hearing on these rule changes.
Motion by Marquardt, seconded by Tidball, to approve these recommended changes. Motion carried (all ayes). The Commission unanimously approved both speed zone rule amendments.

Bill Nevin, Legal Counsel, gave a brief update on the DM&E. With Justice Admundson’s new position as the Sioux Falls City Attorney, the DOT is in the process of hiring former Chief Justice Robert Miler to take over as Hearing Examiner.

Secretary Bergquist discussed with the Commission the legislative committee appointed by the Executive Board to conduct a summer study of highway needs and funding. The first meeting of the summer study committee occurred on June 19, 2008, with the Department providing the committee with a large amount of background information as to available revenue sources and their use, highway categories and jurisdiction, construction inflation and road/bridge conditions and projections. The committee will meet again on September 24-25, during which the Department will provide more detailed information as to projected state highway needs and a summary of available options, including what other states may be doing, and their potential impacts. Two research technical panels will be gathering data on local highway system needs and on various funding options for the committee's consideration.
Secretary Bergquist updated the Commission as to the ongoing concern with federal funding for FFY 2009. The federal highway trust fund is projected to be $3.2 billion short of meeting the commitments of SAFETEA-LU by September 2009 and this number may be even larger with the decrease in travel nationwide. South Dakota could potentially lose over $7 million in federal highway funds for next year if a solution to the shortfall is not found. There was an attempt in Congress to attach a fix to the federal highway fund shortfall to need legislation to extend FAA funding, but today the Senate passed the FAA extension legislation without including a fix for the highway shortfall. Nationwide travel was down substantially in March and April of this year compared with last year, further reducing available revenues into the trust fund.

Jeff Senst, Aberdeen Region Engineer, presented a request to the Commission for relinquish control of access on US12 for Mr. Bill Welk. Action was deferred at last months meeting. Jeff spoke with Mr. Welk’s neighbor and the neighbor was not interested in sharing the approach. Jeff asked for Commission approval to relinquish this control of access in favor of Mr. Welk because of his permit dated 1994 and there are really no other options that he can see.
Motion by Tidball, seconded by Marquardt, to approve relinquishment of control of access on US12 to Mr. Bill Welk. Motion carried (all ayes).

Mr. Bill Welk addressed the Commission briefly. He wanted to thank the great job DOT did in Aberdeen. It is a fast growing community. He also requested we look at the limited access and adding a light on Hwy 14.

Joel Gengler, Right of Way Program Manager, presented the following right-of-way items for Commission consideration:
1. Dispose of Excess Property – Moody County
Request approval to dispose of the following property: West 495 feet of the South 264 feet of the SW1/4 of Section 20, Township 107 North, Range 49 West, 5th P.M., Moody County, South Dakota, less Lot H2. (Appraised value: $1,000).
The above property contains 1.63 acres located on the north side of Highway 32 approximately six miles west of Flandreau and one mile east of I29. The property is marginal pasture land and excess from a Highway 32 construction project. Additional access will not be allowed from Highway 32 without Department approval. (See attached).
Motion by Tidball, seconded by Fouberg, to approve dispose of excess property in Moody County. Motion carried (all ayes).
2. Land Trade – Pennington County
The Department is proposing to trade: Tract NW66; balance of Lots 12 through 16 and the North 10 feet of Vacated Alley adjacent to Lots 12 through 16, Block 66, Original Town of Rapid City, Pennington County, South Dakota, less Lots H1 and Lot H2 (known as Wolfe’s Bargain Den) to the City of Rapid City for: Parcel 21 - Lot H2 in the E1/2 NW1/4 of Section 19, Township 1 North, Range 8 East, B.H.M., less the MJK Subdivision in the City of Rapid City, Pennington County, South Dakota (Lot H2 contains 2.51 acres, more or less) and Parcel CA28 – NE1/4 of Section 19, Township 1 North, Range 8 East, B.H.M., less the MJK Subdivision in the City of Rapid City, Pennington County, South Dakota.
This trade is necessary for Project NH 2016(17)64, PCN 6875 (Highway 16B/Catron Boulevard). Rapid City will reimburse the Department for the difference in the appraisal amounts. (See attached).
Motion by Gregerson, seconded by Fouberg, to approve land trade in Pennington County. Motion carried (all ayes).
3. Transfer – Lincoln County
The Department is proposing to transfer Lot A in Lot H2 in Lot 1 of the SE1/4 of Section 19, Township 100 North, Range 50 West, 5th P.M., Lincoln County, South Dakota (contains 206 sq. ft., more or less) to the landowner. There was a survey bust that caused this little sliver of land and this transfer will clear this matter up. (See attached).
Motion by Tidball, seconded by Marquardt, to approve transfer in Lincoln County. Motion carried (all ayes).
4. Abandonment – Minnehaha County
The Commission first addressed this issue during its April, 2008 meeting. The April resolutions stated that the abandonment’s would occur if certain conditions were met. The conditions have now been met and two (2) additional resolutions need to be filed stating that all conditions have been met.
There are two (2) resolutions with this request. One of the resolutions will abandon Lot AB in a portion of Lot H2 in the NE1/4 of Section 24, Township 101 North, Range 49 West, 5th P.M., Minnehaha County, South Dakota. Lot AB contains 5.94 acres, more or less. (see attached).
This abandonment is based upon the occurrence of the following conditions: (1) closure of the road lying over and across the above-referenced Lot AB; (2) the completion of grading work within said Lot AB by the State’s contractors as part of the Department’s pending highway construction project designated Project No. P 0011(17)71, PCN 6922; and, (3) the receipt of a permanent utility easement over and across said Lot AB by the State. The State will retain control of access to and from abutting streets and highways and will receive a 15 foot wide public utility easement. These conditions have been met.
The second resolution will abandon temporary easement on Parcels 5, 6 and CA20 on Projects P 0042(14)369, PCN 5633 and P 0011(17)71, PCN 6922. These temporary easements are also located in the NE1/4 of Section 24, Township 101 North, Range 49 West and consists of approximately 1.5 acres in Parcel 5, 1.8 acres in Parcel 6. (Shown by blue hatch marks on right of way plan sheets numbered 5, 6, 7 and 18 and are attached as Exhibit A). The State will retain approximately 0.2 acre in Parcel 5 and 0.4 acre in Parcel 6. (Shown in pink cross-hatch marks on Exhibit A that is attached).
This abandonment of the temporary easement is based upon the occurrence of the following conditions: (1) the closure of the existing South Dakota Highway 11 in the vicinity of the easement area; (2) the completion of grading work with the temporary easement abandonment area by the State’s contractors as part of the Department’s pending highway construction projects designated Project No. P 0011(31)70, PCN 01AA; and, (3) the receipt of the reimbursement sum of $38,600 from Dawley Family Legacy I, LLC, representing the price paid by the State for the portion of the temporary easement acquired but not excavated in the State’s highway construction activities. These conditions have been met.
These are conditions of settlement for the above referenced projects and have been negotiated by the Departments legal staff.
Motion by Tidball, seconded by Kranz, to approve abandonment of Lot AB in Minnehaha County. Motion carried (all ayes).

Resolution Number 2008-06.03 was approved
5. Abandonment – Charles Mix County
This resolution will abandon the Geddes Roadside Park. The Department held approximately 2 1/2 acres, located east of Pease Creek and west of Highway 50, NE1/4 of Section 25, Township 97 North, Range 67 West as an easement, to be used for a roadside park. With this abandonment the property will revert back to the previous owner.
Motion by Gregerson, seconded by Tidball, to approve abandonment in Charles Mix County. Motion carried (all ayes).
Resolution Number 2008-06.04 was approved
6. Abandonment – Jones County
This resolution will abandon the roadside park south of Murdo, South Dakota. The Department held approximately one acre, located on the east side of US Highway 83 at the White River Bridge, located in the SW1/4 NW1/4 of Section 8, Township 4 South, Range 29 East, Jones County, South Dakota. Beginning at the point of junction between Highway 83 at the White River commencing 70 feet due east from north-east edge of bridge spanning White River, beginning at first large cottonwood tree, going north along Highway 83 a distance of 500 feet, thence east 150 feet, thence south 500 feet, thence west 150 feet to starting point leaving stock pass area between park area and river bank. With this abandonment the property will revert back to the previous owner.
Motion by Gregerson, seconded by Kranz, to approve abandonment in Jones County. Motion carried (all ayes).

Mr. Larry Poppens spoke in opposition to revision 08-039 that proposed to remove a bridge overpass on Interstate 29. Mr. Poppens stated the overpass connected property he farmed on each side of the interstate and was popular with other local travelers.

Secretary Bergquist passed out to the Commissioners a paper copy of the slide show that was presented during the Summer Study meeting. He invited the Commissioners to attend the upcoming meetings.
Now that the second floor construction of the DOT building is complete, Secretary Bergquist took the Commissioners on a tour of the building.
The Commission took a recess for the building tour at 10:25 a.m. and reconvened at 11:07 a.m.

Commissioner Marquardt gave a big and appreciative thank you to the DOT and all their employees who have helped with the weight restrictions and closing of the Meridian Bridge in Yankton. Things have gone very smoothly due to everyone’s help and working together. The bridge is on schedule and an October 2008 re-opening is scheduled.
