Chairman Marquardt called the meeting to order at 8:58 a.m.
Motion by Tidball, seconded by Fouberg, to approve the August 28, 2008, Commission Meeting Minutes. Motion carried (all ayes).

Chairman Marquardt invited the Commissioners and DOT Staff to attend the Discovery Bridge Dedication and Ribbon Cutting in Yankton on Saturday, October 11, 2008. Governor Rounds has been invited to speak as well as Nebraska’s Governor and our three SD Delegates. The event starts at 10 a.m.
Commissioner Benson announced that Commissioner Rodney Fouberg has been inducted into the SD Hall of Fame. Commissioner Benson said this is a big honor for Commissioner Fouberg and the Commission congratulated him.

Bill Nevin, Legal Counsel, requested the Commission to set a hearing date to amend speed zone rules 70:01:02:01(2) in Minnehaha County, 70:01:02:60(1) in Tripp County, 70:01:02:60(7) in Tripp County, 70:01:02:60(8) in Tripp County, and 70:01:02:60(2) in Tripp County.
Motion by Tidball, seconded by Spies, to set a hearing date for October 23, 2008, to amend speed zone rules 70:01:02:01(2) in Minnehaha County, 70:01:02:60(1) in Tripp County, 70:01:02:60(7) in Tripp County, 70:01:02:60(8) in Tripp County, and 70:01:02:60(2) in Tripp County. Motion carried (all ayes).

Joel Gengler, Right of Way Program Manager, presented the following right-of-way items for Commission consideration:
1. Dispose of Excess Property – Yankton County
Request approval to dispose of the following property: Lot 3 and the West 12 feet
of Lot 4 except the North 95 feet thereof, Block 2, Todd’s Addition, City and
County of Yankton, South Dakota, less Lot H1. (Appraised value: $52,000.00).
The above property contains 5,219 sq. ft. and was purchased in 2004 for the Missouri River bridge project BRF 0081(45)0. Location is 100 Broadway Avenue in Yankton. A 1,788 sq. ft. three bedroom house in disrepair is included with the property. Yankton Area DOT advises the property is not needed for future department use. (See attached).
2. Dispose of Excess Property – Yankton County
Request approval to dispose of the following property: Lot D and Lot 4, Block 1,
Witherspoon’s and Todd’s Additions, City and County of Yankton, South Dakota.
(Appraised value: $78,800.00).
The above property contains 13,146 sq. ft. and was purchased in 2004 for the Missouri River bridge project BRF 0081(45)0. Location is 101 Broadway Avenue in Yankton. A two-story house in very poor shape is included with the property. Yankton Area DOT advises the property is not needed for future department use. (See attached).
3. Dispose of Excess Property – Yankton County
Request approval to dispose of the following property: Lots 5 and 6, Block 1,
Witherspoon’s and Todd’s Additions, City and County of Yankton, South Dakota.
(Appraised value: $79,000.00).
The above property contains 13,200 sq. ft. and was purchased in 2004 for the Missouri River bridge project BRF 0081(45)0. Location is 111 Broadway Avenue in Yankton. A small 1 1/2 story house in poor shape is included with the property. Yankton Area DOT advises the property is not needed for future department use. (See attached).
Motion by Shoener, seconded by Benson, to approve dispose of excess property in Yankton County. Motion carried (all ayes).
4. Land Trade – Stanley County
A block-out had to be moved on Parcel 1A, under Project NH 0083(09)118, PCN
6171. The original block-out was acquired as Lot H1. Lot H2 is the new block-
out location. The Department would like to swap locations for the necessary
block-out. (See attached).
Motion by Tidball, seconded by Spies, to approve land trade in Stanley County. Motion carried (all ayes).
5. Transfer – Minnehaha County
This resolution with transfer the following property to the City of Sioux Falls: County Auditor’s Lot H1 in the SW1/4 of 3-T101N-R49W; County Auditor’s Lot H2 in the SW1/4 of 3-T101N-R49W; County Auditor’s Lot H3 in the SW1/4 of 3-T101N-R49W; and, Lot H4 in the S1/2 S1/2 S1/2 of 3-T101N-R49W.
This area is where the City of Sioux Falls recently reconstructed Cliff Avenue and is no longer needed for highway purposes.
Motion by Fouberg, seconded by Spies, to approve transfer in Minnehaha County. Motion carried (all ayes).
Resolution Number 2008-09.01 was approved
6. Relinquish Section Line Right of Way – Minnehaha County
This resolution will relinquish the State’s interest in section line right of way along
the west line of the SW1/4 of 3-T101N-R49W, that adjoins County Auditor’s Lot
H1, County Auditor’s Lot H2 and County Auditor’s Lot H3 and section line right of
way along the south line of the SW1/4 of 3-T101N-R49W, that adjoins County
Auditor’s Lot H2 and Lot H4 in the S1/2 S1/2 S1/2 of Section 3.
This area is in conjunction with #5 on this agenda and is where the City of Sioux Falls recently reconstructed Cliff Avenue. This section line right of way is no longer needed for highway purposes.
Motion by Tidball, seconded by Fouberg, to approve relinquish section line right of way in Minnehaha County. Motion carried (all ayes).

7. Transfer – Pennington County
This resolution will transfer the following property to the City of Rapid City: Lot
H1 of the N1/2 NE1/4 of 32-T2N-R8E and Lot H1 of Tract F in the N1/2 NE1/4 of
32-T2N-R8E.
This section of the road is a portion of an overall swap agreement for Eglin Street and North Creek Drive. The goal is to help Rapid City do some preparation to reconstruct a short section of Eglin Street. (See attached).
Motion by Shoener, seconded by Spies, to approve transfer in Pennington County. Motion carried (all ayes).
