Chairman Marquardt called the meeting to order at 9:00 a.m.

Motion by Tidball, seconded by Spies, to approve the September 25, 2008, Commission Meeting Minutes. Motion carried (all ayes).

Bill Nevin, Legal Counsel, requested the Commission to set a hearing date to amend speed zone rules 70:01:02:01(2) in Minnehaha County, 70:01:02:60(1) in Tripp County, 70:01:02:60(7) in Tripp County, 70:01:02:60(8) in Tripp County, and 70:01:02:60(2) in Tripp County.

Motion by Shoener, seconded by Fouberg, to set a hearing date for November 20, 2008, to amend speed zone rules 70:01:02:01(2) in Minnehaha County, 70:01:02:60(1) in Tripp County, 70:01:02:60(7) in Tripp County, 70:01:02:60(8) in Tripp County, and 70:01:02:60(2) in Tripp County. Motion carried (all ayes).

Bill Nevin, Legal Counsel, presented to the Commission the approval of two backup prequalification committee members. Chris Ott for David Knigge and Scott Rabern for Jason Humphrey in the event that one of the members is unavailable. The other two members on the committee are Michael Behm and Hadly Eisenbeisz.

Motion by Shoener, seconded by Spies, to approve Ott and Rabern as alternates for the prequalification committee. Motion carried (all ayes).

Bill Nevin, Legal Counsel, presented to the Commission a brief update on the DM&E hearing. Bill will be attending a teleconference status hearing later this morning at 11 a.m. regarding informal discovery and to possibly set a hearing date.

Scott Rabern, Assistant Construction Engineer, presented the following construction change order for the Rapid City Region:

Ryan Johnson, Specifications Engineer, presented to the Commission the Supplemental Specifications to Standard Specifications for Roads and Bridges.

Motion by Shoener, seconded by Tidball, to approve the Supplemental Specifications to Standard Specifications for Roads and Bridges. Motion carried (all ayes).

Jason Humphrey, Program Manager, Operations, presented to the Commission the 2008-2009 Winter Maintenance Plan.

Motion by Tidball, seconded by Shoener, to approve the 2008-2009 Winter Maintenance Plan. Motion carried (all ayes).

Greg Fuller, Direction of Operations, took a moment to thank everyone involved in putting together this winter maintenance plan and explained the hard work and effort they put in to it. Chairman Marquardt also voiced the Commission’s thanks as well.

Joel Gengler, Right of Way Program Manager, presented the following right-of-way items for Commission consideration:

1. Dispose of Excess Property – Minnehaha County
Request approval to dispose of the following property: Lot A in a portion of Lot H1 in the SW1/4 of Section 12, Township 101 North, Range 50 West, 5th P.M., Minnehaha County, South Dakota (appraised value: $17,755.00); and, Lot A in a portion of Lot H1 in the E1/2 NW1/4 of Section 13, Township 101 North, Range 50 West, 5th P.M., Minnehaha County, South Dakota (appraised value: $15,525.00).

Lot A in Section 12 contains 1.02 acres and Lot A in Section 13 contains 0.89 acre. Location is between I29 and Terry (Ebenezer) Avenue on the south side of Madison Street in Sioux Falls. Access will not be allowed from I29. Sioux Falls Area office advises the property is not needed for future department use. (See attached).

Motion by Trucano, seconded by Shoener, to approve dispose of excess property in Minnehaha County. Motion carried (all ayes).

2. Dispose of Excess Property – Meade County
Request approval to dispose of the following property: Tract B of Stagebarn Subdivision located in portions of the S1/2 NE1/4 and the SE1/4 NW1/4 of Section 23, Township 3 North, Range 6 East, B.H.M., Meade County, South Dakota, less Lot H1. (Appraised value: $147,000).

The above property contains 31,995 sq. ft. and was purchased in 2006 for Project IM 90-1(110)46. Location is on the north side of frontage road Highway 79, west of Exit 48. Tract B contains three wood-frame steel-siding buildings comprising forty-one storage units with renters in approximately seventy percent. Rapid City Area office advises the property is not needed for future department use. (See attached).

Motion by Shoener, seconded by Spies, to approve dispose of excess property in Meade County. Motion carried (all ayes).

3. Deed Land Back to Landowner - Moody County
Request approval to deed the following property back to the landowners it was
acquired from: Lot H6 Amending the Original Plat of Lot H6 as recorded in
Document Number 081005 – Page 251B – Dated May 13, 2008 in the Former
Chicago, Milwaukee, St. Paul and Pacific Railroad Company right of way over
and across the NW1/4 of Section 7, Township 106 North, Range 48 West, 5th
P.M., Moody County, South Dakota. Said Lot H6 contains 0.67 acre, more or
less.

The Department had originally acquired this land from Raymond L. and Valerie K. Luze for Project P-PH 0034(97)406, PCN 6678 and then found out that some of it was owned by the county, so the landowners had to be re-signed and this will deed the above property back to the landowners.

Motion by Spies, seconded by Shoener, to approve deed land back to landowner in Moody County. Motion carried (all ayes).

4. Abandonment – Clark County
This resolution will abandon the Clark Roadside Park. This park is located at the following: Beginning at a point 800 feet west of the SE corner of Section 2, Township 116 North, Range 59 West, thence 180 feet north, thence 1000 feet south, thence 1000 feet east to the point of beginning, Clark County, South Dakota.

6. Abandonment – Hand County
This resolution will abandon the Miller Roadside Park (Cahalan). This park is located at the following: A parcel of land located in the SE1/4 SE/14 of Section 1, Township 112 North, Range 69 West, Hand County, and further described as follows: Beginning at a point 33.0 feet west and 50.0 feet north of the SE corner of Section 1, Township 112 North, Range 69 West, proceed west along the right of way of US Highway 14 a distance of 295 feet, thence north a distance of 290 feet, thence east a distance of 295 feet, thence south a distance of 290 feet to the point of beginning, containing 1.96 acres, more or less.

7. Abandonment – Kingsbury County
This resolution will abandon the DeSmet Roadside Park (DeSmet Forrest). This park is located at the following: 4.8 acres, more or less, lying north of US Highway 14, in the S1/2 NE1/4 SE1/4 of Section 34, Township 111 North, Range 56 West, Kingsbury County, South Dakota.

8. Abandonment – Spink County
This resolution will abandon the Redfield Roadside Park (Druley-Miller). This park is located at the following: Beginning at a point where the highway right-of-way intersects the 1/2 mile line of Section 10, Township 118 North, Range 64 West, thence westerly along the 1/2 mile line a distance of 100 feet, thence northerly a distance of 200 feet, thence easterly a distance of 100 feet to the highway right-of-way, and thence southerly along the highway right-of-way a distance of 200 feet to the point of beginning, containing 1/3 of an acre, more or less, all in the SE1/4 NE1/4 of Section 10, Township 118 North, Range 64 West, Spink County, South Dakota.

Motion by Tidball seconded by Spies, to approve abandonments in Clark, Hand, Kingsbury, and Spink Counties. Motion carried (all ayes).

Resolution Numbers 2008-10.01 – 2008-10.04 were approved

5. Abandonment – Haakon County
This resolution will abandon the Midland Roadside Park. This park is located at the following: Lot H-2 in the S1/2 SE1/4 of Section 1, Township 1 North, Range 24 East of the B.H.M., in Haakon County, South Dakota, as shown by plat made by John W. Wright, Registered Land Surveyor, under date of September 17, 1959; said plat to be filed in the Office of the Register of Deeds, Haakon County, South Dakota. Lot H-2 contains 7.99 acres, more or less.

This land was acquired for a park under Project F026-3(1).

The Department requests retracting this item from consideration to a future Commission meeting. A plat needs to be prepared to better define the area to be abandoned. The Department abandonment recommendation for this item is anticipated for the November 2008 Commission meeting provided the plat can be prepared in that timeframe.

9. Abandonment – Day County
This resolution will abandon all of the temporary easements on Project NH
0012(95)353, PCN 5864.

10. Abandonment – Roberts County
This resolution will abandon all of the temporary easements on Project NH 0012(95)353, PCN 5864.

11. Abandonment – Edmunds County
This resolution will abandon all of the temporary easements on Project BRF 0012(92)248, PCN 5992.

12. Abandonment – Lyman County
This resolution will abandon all of the temporary easements on Project NH-BRF 0083(12)96, PCN 5857.

13. Abandonment – Brown County
This resolution will abandon all of the temporary easements on Project NH 0012(89)289, PCN 5946.

Motion by Tidball, seconded by Trucano, to approve abandonment in Day County. Motion carried (all ayes).

Motion by Tidball, seconded by Spies, to approve the 2009-20013 Statewide Transportation Improvement Program Revision 09-002. Motion carried (all ayes).

Mike Behm, Assistant Director of Planning & Engineering, presented a brief summary of minor project edits to the 2009-2013 Statewide Transportation Improvement Program Revisions to the Commission as informational items. These edits do not require Commission approval. The Commission liked this information and requested it be presented to them four times a year.

Secretary Bergquist discussed information from the AASHTO Annual Meeting he just returned him. He advised SD DOT was in relatively good shape compared to other states. …….

Secretary Bergquist advised the Commission the next Legislative Summer Study meets November 12 and 13. After this meeting they will finalize and prepare their recommendations and report for the Legislature. …..

Chairman Marquardt thanked Secretary Bergquist for attending the ribbon cutting and dedication of the Discovery Bridge in Yankton. This turned into a great event and had an incredible turnout.
