TRANSPORTATION COMMISSION MEETING
JANUARY 22, 2009

Chairman Marquardt called the meeting to order at 9 a.m.
Motion by Shoener, seconded by Kranz, to approve the December 18, 2008, Conference Call Minutes. Motion carried (all ayes).

Deputy Secretary Kevin Tveidt discussed what bills the DOT has in front of the 2009 Legislation (HB 1023, HB 1024, SB 23, and SB 30) and other bills he DOT is watching (HB 1006, HB 1007, SB 10, SB 11, SB 21 and SB 32).
Deputy Secretary Kevin Tveidt informed the Commission about and gave handouts from Secretary Bergquist’s testimony to the House and Senate Transportation Committees earlier in the session.
Deputy Secretary Kevin Tveidt and Joel Jundt, Director of Planning & Engineering, presented information on the economic stimulus plan, both nationwide and statewide. Joel informed the commission a special meeting or conference call may be needed to approve bid lettings in order to approve STIP amendments of potential projects that currently fall outside FY2009. He informed them that we may need to also add additional lettings in order to handle the additional projects that will be going to contract.
Motion by Trucano, seconded by Shoener, to approve a conference call to handle these bid lettings. Motion carried (all ayes).
A conference call was scheduled for February 19, 2009, at 10 a.m. CST.

Bill Nevin, Legal Counsel, presented an update regarding the DM&E Hearing held in Rapid City January 5-9, 2009. Bills advised he felt the hearing went well. There were five days of testimony with 70 exhibits presented. It was determined on the last day of this hearing to continue with closing arguments on Thursday, January 22, 2009, at 1:30 p.m. at the Stanley County Courthouse. Each side will get one and one half hours to present closing arguments. Justice Miller will then like to meet with the Transportation Commission to get their opinions before preparing a proposed decision. This decision will then come before the Transportation Commission for their approval, rejection, or a modification before the final decision is made.

Commissioner Shoener advised the Commission he has received a number of letters from citizens of Mobridge, S.D., concerning opposition of the DOT re-striping their current four-lane highway through the center of town to a three-lane highway. John Forman, Pierre Regional Engineer, explained to the Commission the DOT felt it was safer to change their current four-lane highway to a three-lane highway with a turn lane down the middle. The business people of Mobridge do not want this and have brought their arguments to the DOT. The business community's concern is for possible economic problems created from a three-lane conversion. The DOT has therefore reconsidered and will keep their current four-lane highway. Deputy Secretary Tveidt advised he would make sure a letter went to citizens who have sent letters to the Commissioners.

Joel Gengler, Right of Way Program Manager, presented the following right-of-way items for Commission consideration:
1. Land Trade – Lincoln County
The Department would like to trade the North 151.95’ of the West 225’ except Lot H1 of the NW1/4 of Section 23, Township 100 North, Range 50 West, 5th P.M., Lincoln County, South Dakota for Lot H2 in the NW1/4, except the West 1320’ of the South 198’ thereof, and except the East 808.54’ of the North 592.62’ including Tract 1 of Beyers Addition contained therein and except the North 151.95’ of the West 225’ thereof, all in Section 23, Township 100 North, Range 50 West, 5th P.M., Lincoln County, South Dakota. There is no money involved in this trade.
This trade is needed for SD Highway 100 and will be used on Project
EM 0100(101)405, PCN 00T7. (See attached).
Motion by Benson, seconded by Spies, to approve land trade in Lincoln County. Motion carried (all ayes).
2. Relinquish Control of Access – Lake County (Amending Amended Resolution)
This resolution will grant a 36 foot approach at MRM 388+0.818 Right and a 40 foot approach at MRM 389+0.147-228 feet Right. This resolution was approved by the Commission during the November 2008 meeting. The 40’ approach was missed on this resolution.
Motion by Kranz, seconded by Shoener, to approve relinquishment of control of access in Lake County. Motion carried (all ayes).

Mike Behm, Assistant Director of Planning & Engineering, presented the 2009-2013 Statewide Transportation Improvement Program Revisions 09-014 and 09-015 to the Commission for their approval.
Motion by Spies, seconded by Trucano, to approve the 2009-20013 Statewide Transportation Improvement Program Revision 09-014. Motion carried (all ayes).
Motion by Shoener, seconded by Benson, to approve the 2009-20013 Statewide Transportation Improvement Program Revision 09-015. Motion carried (all ayes).

Mike Behm, Assistant Director of Planning & Engineering, presented a brief summary of informational project edits to the 2009-2013 Statewide Transportation Improvement Program Revisions to the Commission as informational items. These edits do not require Commission approval.

Amy will send an email to the Commissioners requesting travel information for the DM&E Hearing held in Rapid City at the beginning of the month and get those reimbursements processed.

Commissioner Spies commented that NE SD has a lot of snow yet and is concerned about flooding when the snow melts.
