Secretary Bergquist discussed with the Commission the status of the Stimulus Package President Obama signed in regards to transportation. $189 million dollars was awarded to SD for Highway construction projects. This money is not required to be matched by state funds. 50% of the state's funds must be obligated within 120 days of the money being available. The Department has more than this amount of projects ready and does not anticipate any difficulty in meeting this requirement. At the February 26th Commission meeting, the Department will request the Commission to take action on suballocating a portion of these funds to local government entities. These funds not obligated by states within the required timeframe will revert to Congress and be redistributed to those states that have used all their available funds. The Department is making every effort to ensure it uses all its funds and is in line for any additional funds that may be redistributed.

Mike Behm, Assistant Director of Planning & Engineering, presented a list of program revisions to the 2009 Statewide Transportation Improvement Program for potential funding by the ARARA.
Motion by Shoener, seconded by Marquardt, to approve adopting of the changes in the STIP Program. Motion carried (all ayes).

Bill Nevin, Legal Counsel, presented an update regarding the DM&E Hearing. All parties
have submitted their final briefs. Justice Miller is working on his proposed decision. There is no time frame for this, but hopefully by the March 26, 2009 meeting, Justice Miller will have a proposed decision for the Commission to consider.
