TRANSPORTATION COMMISSION MEETING
March 4, 2009
PIERRE, SOUTH DAKOTA

Present: Ralph Marquardt, Chairman
Jim Spies, Vice Chairman
Jerry Shoener, Member
Rod Fouberg, Member
John Kranz, Member
Mike Trucano, Member


Absent: Dick Gregerson, Member
Sam Tidball, Member
Bob Benson, Member

Others in Attendance: Justice Robert A. Miller, Chet Brokaw, AP


DOT Staff: Bill Nevin, Bruce Lindholm, and Amy Campbell.


Chairman Marquardt called the meeting to order at 9 a.m.

Chairman Marquardt advised the Commission there are two bid lettings related to the Stimulus Package money being held March 4 and 6, 2009. He requested a Conference Call to award these projects.

A conference call will be set up for Tuesday, March 10, 2009, at 9 a.m. CST, to award projects from March 4 and 6, 2009, bid lettings.

Motion by Spies, seconded by Shoener, for the Commission to go into Executive Session. The Commission went into Executive Session at 9:05 a.m. to discuss DM&E Application For Authority to Exercise Eminent Domain.

The Commission reconvened into Regular Session at 9:40 a.m. and took a short break.

Motion by Shoener, seconded by Fouberg, to accept and make as the Commission’s Final Decision the proposed Findings of Fact, Conclusions of Law and Recommendation made by the Hearing Officer, Robert A. Miller, to grant applicant authority to exercise eminent domain west of Wall, SD and deny applicant eminent domain authority east of Wall, SD pending further compliance with SD law. Motion carried (all ayes).

Chairman Marquardt requested for Secretary Bergquist to review the Mission Statement of the DOT, draw out future direction of the department, and have a presentation ready for the regular March 26, 2009, Commission Meeting.

There being no further business, at the hour of 9:48 a.m. the Transportation Commission adjourned.

The next meeting is a conference call on March 10, 2009, at 9 a.m. CST, in the DOT Conference Room 255. The next scheduled commission meeting is March 26, 2009, at 9 a.m., in the DOT Commission Room.
