Chairman Marquardt called the meeting to order at 9:03 a.m.

Motion by Tidball, seconded by Benson, to approve the March 10, 2009, Conference Call Minutes. Motion carried (all ayes).

Bill Nevin, Legal Counsel, advised the Commission that that condemnation Resolutions passed by the Commission were up to this point being signed by the Secretary. From here out, they will be signed by the Chairman of the Transportation Commission. This is the result from a recent legal issue.

Bill Nevin, Legal Counsel, updated the Commission on the DM&E Hearing. The final document has been served on all parties and we are currently waiting out the 30 days for finalization.

Secretary Bergquist discussed the recent blizzard and flooding currently in northern and eastern South Dakota. The Office of Emergency Management has opened the Emergency Operation Center to aid the flood victims.

Secretary Bergquist discussed that the 2009 Legislative season is over except for Monday when they return to Pierre to consider any vetoes issued by the Governor. The four proposed legislative issues by DOT were all passed, including new legislation granting the commission authority to restrict the use of OHVs within the state highway right-of-way. There were no changes passed to the highway funding, either at the local or state level.

Secretary Bergquist discussed an issue brought up at the last meeting regarding how applications to construct approaches for new access points to the state highway are handled. If the request includes a relinquishment of control of access, the Commission is required to approve the relinquishment by the state of the property interest. If the request does not require relinquishment of control of access, a different process is prescribed that includes an administrative hearing before a hearing examiner followed by a possible appeal to circuit court.

Secretary Bergquist discussed where we are in the economic stimulus process and expenditure of those funds. Included within the economic stimulus package for SD is $5.5 million in transportation enhancement funds to be spent on such things as bike paths and walking trails. The Department intends to make recommendations to the Commission at the April 23, 2009 meeting as to projects to be funded through the transportation enhancement funds.

Motion by Benson, seconded by Fouberg, to approve the proposed price changes. Motion carried (all ayes).

Greg Fuller, Director of Operations, presented to the Commission a proposal to name Highway 20 from the junction of US Hwy 83 west of Onaka and continue to the east beyond Cresbard to the junction with US Hwy 281 after Captain Cecil E. Harris.

Motion by Fouberg, seconded by Benson, to approve the proposal to name Highway 20 Cecil E Harris, Captain US Navy, Memorial Highway, from the junction of US Hwy 83 west of Onaka and continue to the east beyond Cresbard to the junction with US Hwy 281. This will be marked by a 60” x 24” highway sign. Motion carried (all ayes).

Project 10 from the March 4, 2009 letting was let pending good faith effort documentation. Lack of DBE solicitation which is required by contract was not met and therefore awarded to the second low responsive bidder; Roadway Services, Inc.

Motion by Benson, seconded by Fouberg, to award project 10 to the second low responsive bidder. Motion carried (all ayes).

Mike Behm, Assistant Director of Planning & Engineering, presented the 2009-2013 Statewide Transportation Improvement Program Revisions 09-019, 09-020, 09-021, 09-022, 09-024, 09-025, 09-026, 09-027, and 09-028 to the Commission for their approval.

Discussion was raised on Program Revision 09-024. Jeff Wiedow, landowner from Hot Springs, SD, addressed the Commission. Mr. Wiedow advised the Commission he was not opposed to this project, but has concerns for safety of the project. He requests the DOT re-look at this design for this project and consider re-designing the intersection. The proposed intersection aligns up to his house and driveway and a concrete wall will be place right in front of his house. He advises this is not safe for himself or others using this intersection. He would like to ask for a public meeting, and notification of such, and a possible re-design of this intersection. Mike Behm advised we will keep in touch with the landowners and re-look at this intersection by a public meeting and design review.

Motion by Benson, seconded by Fouberg, to approve the 2009-20013 Statewide Transportation Improvement Program Revisions 09-024. Motion carried (all ayes).

Motion by Kranz, seconded by Tidball, to approve the 2009-20013 Statewide Transportation Improvement Program Revisions 09-019, 09-020, 09-021, 09-022, 09-025, 09-026, 09-027, and 09-028. Motion carried (all ayes).

Joel Jundt, Director, Division of Planning and Engineering, presented the Commission with changes to the Brookings County Highway System and Haakon County Highway System. The description of these routes are as follows:

Brookings County, add 34th Avenue. Legal description is as follows: The section line road beginning at the NW corner of section 32,T110, R49 west of the 5th P.M. Brookings County South Dakota and progressing south along the west section line of such section for a distance of 1 mile to the SW corner of such section. The section line road beginning at the NW corner of section 5, T109, R49 west of the 5th P.M. Brookings County, South Dakota and progressing south along the west section line of such section for a distance of 1 mile to the SW corner of such section.

Haakon County, delete Unknown named highway. Legal description is as follows: Starting at the midsection of T1N, R20E, Section 25, then heading southeast approximately 1.547 miles to the midpoint of T1N, R21E, Section 30.

Haakon County, add 234th Street. Legal description is as follows: Starting at the midsection of T1N, R21E, section 30, then heading west approximately 0.953 miles to the intersection of SD73 at the quarter section of T1N, R20E, section 25.

Motion by Tidball, seconded by Benson, to approve changes to the Brookings and Haakon County Highway Systems. Motion carried (all ayes).
