Motion by Tidball, seconded by Shoener, to approve the March 26, 2009, Commission Meeting Minutes. Motion carried (all ayes).

Secretary Bergquist advised the Commission that Commissioner Spies’s and Commissioner Fouberg’s terms expired following the last commission meeting and Governor Rounds re-appointed both of them for another four year term. Congratulations Commissioners!
Secretary Bergquist advised that the Legislative Executive Board met on Monday to finalize the legislative summer studies to be done this year. The Department is scheduled for its periodic "sunset review" study which will also included issues regarding future highway funding. Commissioner Gregerson requested that Secretary Bergquist will try to schedule these meetings the day before a commission meeting so the Commissioners can come to town and participate if they choose.
Secretary Bergquist passed out a handout regarding the Economic Stimulus Package showing where we currently stood in relation to the stimulus money and letting of projects.
Secretary Bergquist advised the Commission of the need for an Executive Session to discuss a contractual matter after completing the agenda items.

Joel Gengler, Right of Way Program Manager, presented the following right-of-way items for Commission consideration:
1. Abandonment – Meade County
This resolution will abandon Lot AB1 in a portion of Lot H1 of Lot A
of the SE1/4 NE1/4 in Section 16, Township 5 North, Range 5 East
(contains 13516.5 sq. ft.) and Lot AB2 in a portion of Lot H2 of Lot 1
of the SE1/4 NE1/4 in Section 16, Township 5 North, Range 5 East
(contains 4266.4 sq. ft.).
The abandonment’s are part of the agreement that was signed by the
Department and the City of Sturgis on February 2, 2009. This action
will complete the agreement. (see attached).
Motion by Tidball, seconded by Kranz, to approve abandonment in Meade County. Motion carried (all ayes).

Motion by Benson, seconded by Kranz, to approve the 2009-20013 Statewide Transportation Improvement Program Revision 09-023. Motion carried (all ayes).
Motion by Tidball, seconded by Shoener, to approve the 2009-20013 Statewide Transportation Improvement Program Revision 09-029. Motion carried (all ayes).

Dave Huft, Research Program Manager, gave a presentation to the Commission regarding the Winter Maintenance Decision Support System (MDSS) and Mobile Data Collection. MDSS analyzes current road conditions, current and forecasted weather, the behavior of snow, ice, and deicing chemicals, available material, equipment, and manpower resources to recommend optimal winter maintenance treatments and timings. Use of MDSS can generate significant savings in winter maintenance costs and improvements in winter service levels. South Dakota is the lead state in a group of 15 states developing and deploying MDSS.

Bill Nevin, Legal Counsel, updated the Commission on the DM&E case. Bill advised a Notice of Appeal was filed by four landowners to the Circuit Court. The DM&E filed a Notice of Review for the court to address the issue concerning the 90-day deadline for completing all proceedings under the new statute. The railroad filed a motion asking the Circuit Court to dismiss the appeal filed by the landowners for failure to name the Transportation Commission as a party. Bill expects to meet with the parties within the next week to discuss the record to be transmitted to the Circuit Court.

Motion by Tidball, seconded by Shoener, for the Commission to go into Executive Session. The Commission went into Executive Session at 10:56 a.m. to discuss contractual matters.
The Commission reconvened into Regular Session at 11:30 a.m.
