Chairman Marquardt called the meeting to order at 9 a.m.

Motion by Tidball, seconded by Benson, to approve the April 23, 2009, Commission Meeting Minutes. Motion carried (all ayes).

Bill Nevin, Legal Counsel, informed the Commission that Commissioner Dick Gregerson has been chosen as the 2009 recipient of the prestigious Marshall M. McKusick award for outstanding service to his profession, his community, and the State Bar Association.

Bill Nevin, Legal Counsel, presented information regarding proposed changes in speed
zone rules 70:01:02:04 (5) Beadle County Speed Zone, 70:01:02:14 (1) Buffalo County Speed Zone, 70:01:02:14 (2) Buffalo County Speed Zone, 70:01:02:14 (3) Buffalo County Speed Zone, 70:01:02:14 (4) Buffalo County Speed Zone, 70:01:02:63 (5) Walworth County Speed Zone, and 70:01:02:67 (1) Todd County Speed Zone.

Motion by Shoener, seconded by Tidball, to approve the proposed recommended changes. Motion carried (all ayes).

Resolution Number 2009-5.01 was approved

Bill Nevin, Legal Counsel, requested the Commission to set a hearing date to consider the amendment of speed zone rules 70:01:02:01 (2) Minnehaha County Speed Zone, 70:01:02:60 (1) Tripp County Speed Zone, 70:01:02:60 (2) Tripp County Speed Zone, 70:01:02:60 (70) Tripp County Speed Zone, and 70:01:02:60 (8) Tripp County Speed Zone.

Motion by Benson, seconded by Tidball, to set a hearing date for June 25, 2009, to consider the amendment of speed zone rules 70:01:02:01 (2) Minnehaha County Speed Zone, 70:01:02:60 (1) Tripp County Speed Zone, 70:01:02:60 (2) Tripp County Speed Zone, 70:01:02:60 (70) Tripp County Speed Zone, and 70:01:02:60 (8) Tripp County Speed Zone. Motion carried (all ayes).

Resolution Number 2009-5.02 was approved

Secretary Bergquist updated the Commission on the two Legislative Summer Studies. The first meeting is scheduled for June 23 and 24, 2009, with the first day being devoted to the sunset study and the second day focusing on highway needs and funding. Commissioners are welcome to attend and there is some indication the committee may want to hear from one or more of the commissioners. Commissioner Marquardt requested the Department provide the Commissioners with a list of names on the Summer Study Committee.

Secretary Bergquist advised the Commission of the need for an Executive Session to discuss legal and contractual matters after completing the agenda items.

Commissioner Gregerson asked how the Department would be handling requests for prohibiting off road vehicles from state highway right-of-way and does the Commission have rule make authority. He was advised that while the Commission was given the authority to prohibit use of highway right-of-way segments by off road vehicles, the legislation did not grant the Commission rule making authority. Constituents requesting closure of specific segments are being referred to their local Area Office and the Area Offices will gather the necessary information to be presented to the Commission after July 1, 2009.

Secretary Bergquist requested the Transportation Enhancements be withdrawn from today’s meeting as we are still receiving applications and going through them. A conference call has been set for June 11, 2009, at 9 a.m. to award approval of the Transportation Enhancements.

Scott Rabern, Assistant Construction Engineer, presented the following construction change order for the Aberdeen Region:

Joel Gengler, Right of Way Program Manager, presented the following right-of-way items for Commission consideration:

1. Dispose of Excess Property – Codington County
Request approval to dispose of the following property: Lot EP1 in the
SW1/4 of Section 24, Township 117 North, Range 53 West, of the 5th
P.M., Codington County, South Dakota. (Appraised value: $179,000).

The above property contains 21.58 acres purchased in 2002 from Vicky
Wilkey and Sandra Omland Schletz for Project P 0020(68)364, PCN
4792. Location is northwest of the Highway 20 and 14th Avenue
intersection in Watertown. Access will not be allowed to Highway 20.
Watertown Area Office advises the property is not needed for future
department use.

Motion by Benson, seconded by Spies, to approve dispose of excess property in Codington County. Motion carried (all ayes).

2. Transfer – Pennington County
This resolution will transfer all of the property that was agreed to under
Agreement #612885 between the department and the City of Rapid
City. This agreement was signed January 20, 2003 for Project
IM 090-2(00)55, PCN 107N. It was agreed to relocate the existing
northeast service road (Lange Road). (See attached copy of Agreement
#612885).

Motion by Shoener, seconded by Tidball, to approve transfer in Pennington County. Motion carried (all ayes).

Resolution Number 2009-05.03 was approved

3. Transfer – Lincoln County
This resolution will transfer to the City of Sioux Falls property that will
be used for street and utility improvements on the city’s 69th Street,
Tallgrass Avenue to Connie Avenue project. Road Design and the
Sioux Falls Area Office concurs with this transfer. (see attached).

Motion by Tidball, seconded by Trucano, to approve transfer in Lincoln County. Motion carried (all ayes).

Resolution Number 2009-05.04 was approved

4. Abandonment – Lincoln County
This resolution will abandon the temporary easement on Parcel 45 on
Project P 0115(38)76, PCN 5965.

Motion by Tidball, seconded by Kranz, to approve abandonment in Lincoln County. Motion carried (all ayes).

Resolution Number 2009-05.05 was approved

5. Abandonment – Pennington County
This abandonment request was approved by the Transportation
Commission during its February 17, 2009 meeting. This abandonment
is part of Tower Roads near Rapid City and is no longer needed for
highway purposes.

This second resolution acknowledges that all conditions for
abandonment have been met and therefore the property is abandoned.

Motion by Shoener, seconded by Spies, to approve abandonment in Pennington County. Motion carried (all ayes).

Mike Behm, Assistant Director of Planning & Engineering, presented the 2009-2013 Statewide Transportation Improvement Program Revisions 09-032 and 09-033 to the Commission for their approval.

Motion by Benson, seconded by Tidball, to approve the 2009-20013 Statewide Transportation Improvement Program Revisions 09-032 and 09-033. Motion carried (all ayes).

The commission took a recess at 10:15 a.m. and reconvened at 10:25 a.m.

The Commission discussed the topics of highway classification, functionality, and responsibility. Chairman Marquardt questioned whether the Department should be seeking to have some segments of state highway removed from the state system. This discussion included whether there were state highways that more properly should be on the county highway system and whether there were other roads being maintained by local government entities that should be on the state highway system. Secretary Bergquist and Bill Nevin discussed with the Commission the existing statutorily established process and requirements for removing a segment of highway from the state system. Secretary Bergquist advised the Commission it was likely this was a topic that would be considered by the Legislative Summer Study Committee examining the issues of highway needs and highway funding.

Motion by Benson, seconded by Spies, for the Commission to go into Executive Session. The Commission went into Executive Session at 10:55 a.m. to discuss legal and contractual matters.

The Commission reconvened into Regular Session at 11:35 a.m.
