Chairman Marquardt called the meeting to order at 9:01 a.m.
Motion by Shoener, seconded by Tidball, to approve the June 11, 2009, Conference Call Meeting Minutes. Motion carried (all ayes).

Bill Nevin, Legal Counsel, presented information regarding proposed changes in speed
zone rules; 70:01:02:01 (2) in Minnehaha County, 70:01:02:60 (1) in Tripp County, 70:01:02:60 (2) in Tripp County, 70:01:02:60 (7) in Tripp County, and 70:01:02:60 (8) in Tripp County.
Motion by Benson, seconded by Tidball, to approve the proposed recommended changes. Motion carried (all ayes).
Resolution Number 2009-6.01 was approved
Bill Nevin, Legal Counsel, requested the Commission to set a hearing date to consider the amendment of speed zone rule 70:01:02:49 (15) in Meade County.
Motion by Shoener, seconded by Benson, to set a hearing date for July 23, 2009, to consider the amendment of speed zone rule 70:01:02:49 (15) in Meade County. Motion carried (all ayes).

Secretary Bergquist updated the Commission on the first meeting of the Legislative Summer Study Committee conducting a review of the Department as well as continuing to study highway needs and funding options. Secretary Bergquist reported the meetings went well and Commissioners Marquardt and Tidball also attended and addressed questions of the committee. The next meetings are scheduled for August 19-20th and October 13-14th.
Secretary Bergquist updated the Commission on the status of the pending federal Highway Trust Fund shortfall. Currently, approximately $7 billion is needed for the trust fund to make anticipated reimbursements through September 30, 2009, with an additional approximately $8 billion needed to extend the existing program through next year at the current level.
Secretary Bergquist provided the Commission with handouts showing the construction projects tentatively scheduled to be let in upcoming months and a summary of economic stimulus funded projects that are either let or scheduled to be let.
Secretary Bergquist provided the Commission with copies of a letter and packet received from the group requesting a four-lane from Madison to the interstate and advised the information was for their consideration when they approved the STIP later this year.

Greg Fuller, Director of Operations, presented to the Commission a proposal to name a segment of US Highway 212 from Belle Fourche west to the Wyoming state line as Warrior Trail.
Motion by Fouberg, seconded by Tidball, to approve the proposal to name a segment of US Highway 212 from Belle Fourche west to the Wyoming state line as Warrior Trail. This will be marked by a 30” x 24” highway sign. Motion carried (all ayes).
Greg Fuller, Director of Operations, presented to the Commission a proposal to name a segment of US Highway 16/385 between the cities of Hill City and Custer and passes adjacent to the Crazy Horse Memorial carving for Chief Crazy Horse.
Motion by Gregerson, seconded by Shoener, to approve the proposal to name a segment of US Highway 16/385 between the cities of Hill City and Custer and passes adjacent to the Crazy Horse Memorial carving for Chief Crazy Horse. This will be marked by a 24” x 30” highway sign. Motion carried (all ayes).

Representative Lance Russell, Hot Springs, SD, addressed the Commission regarding interstate median mowing. Representative Russell represents Custer and Fall River counties and the portion of Pennington County that includes Wall and Quinn. A few landowners have contacted Representative Russell concerning a letter received from the DOT in May 2009 regarding a change in policy to disallow the mowing of medians by contract. Many of the landowners use the hay they mow for their livestock and depend on this for their feed. The letter states the changes were due to concerns about liability and public safety. Representative Russell advised there have been no fatalities along this stretch of interstate and would like for the landowners to continue mowing.
Gordon Pederson and Don Kelly also testified before the Commission regarding how the landowners rely on this mowing and would like to continue it. They also mentioned there have been no fatalities.
Secretary Bergquist informed the Commission the program could be continued this summer to allow time for a complete review of the program and any necessary administrative rule changes.
Motion by Shoener, seconded by Benson, for the DOT to review the policy relating to the interstate median mowing and make any recommendation of changes before the first of the year.

Joel Gengler, Right of Way Program Manager, presented the following right-of-way items for Commission consideration:
1. Dispose of Excess Property – Roberts County
Request approval to dispose of the following property: SW1/4 NE1/4 of
Section 1, Township 123 North, Range 51 West of the 5th P.M., Roberts
County, South Dakota, less Lot H1. (Appraised value: $57,800).
The above property contains 33.99 cropland acres and was purchased
for an interstate project in 1977. Location is along the east side of I29
approximately five and one-half miles south of Exit 224 (Peever Exit).
Zoning is agricultural. Watertown Area Office advises the property is
not needed for future department use.
Motion by Benson, seconded by Fouberg, to approve dispose of excess property in Roberts County. Motion carried (all ayes).
2. Dispose of Excess Property – Roberts County
Request approval to dispose of the following property: S1/2 NE1/4 of
Section 15, Township 122 North, Range 52 West of the 5th P.M.,
Roberts County, South Dakota, except that portion conveyed to Roberts
County in Book of Deeds 29, Page 251. (Appraised value: $67,700).
The above property contains 75.19 acres, including a former
Department gravel/borrow pit, and was purchased in 1959. Location is
along a county road approximately two miles east and one-half mile
north of Ortley. Zoning is agricultural. Watertown Area Office advises
the property is not needed for future department use.
Motion by Tidball, seconded by Shoener, to approve dispose of excess property in Roberts County. Motion carried (all ayes).
3. Abandonment – Union County
The Department has been requested to abandon Lot P1 in the NW1/4 of
Section 15, Township 89 North, Range 48 West of the 5th P.M., in
Union County, South Dakota. Lot P-1 contains 1.52 acres, more or less.
This property is no longer needed for highway purposes and Road
Design and the Region/Area Offices concur in this abandonment. (see
attached).
Motion by Shoener, seconded by Tidball, to approve abandonment in Union County. Motion carried (all ayes).

Motion by Benson, seconded by Tidball, to approve the 2009-20013 Statewide Transportation Improvement Program Revision 09-034. Motion carried (all ayes).
Motion by Shoener, seconded by Fouberg, to approve the 2009-20013 Statewide Transportation Improvement Program Revision 09-035. Motion carried (all ayes).

Joel Jundt, Director of Planning & Engineering, presented the Tentative 2010-2014 Statewide Transportation Improvement Program (STIP) to the Commission and went through the accompanying financial sheets and graph. Jundt requested the Commission concur in submitting the STIP to public comment. The meetings are scheduled during the month of July.
Motion by Tidball, seconded by Shoener, to approve submitting the Tentative 2010-2014 Statewide Transportation Improvement Program (STIP) to the public. Motion carried (all ayes).

Joel Jundt, Director of Planning & Engineering, presented the STIP Public Meeting dates to the Commission and encouraged them to participate in attending one of the five meetings in their respective areas.

Commissioner Marquardt advised he and a few others have received letters from constituents in Irene, SD, regarding their roads and they will more than likely be at the STIP meeting.

Commissioner Gregerson asked about the off road vehicles law taking effect. He had pictures showing areas destroyed from off road vehicles. Secretary Bergquist advised that anyone concerned with a particularly location should notify their local Area Office. These requests would then be brought to the Commission for their consideration after the July 1 effective date of the legislation.
