Chairman Marquardt called the meeting to order at 9:00 a.m.

Motion by Shoener, seconded by Tidball, to approve the June 25, 2009, Commission Meeting Minutes. Motion carried (all ayes).

Bill Nevin, Legal Counsel, presented information regarding proposed changes in speed
zone rule 70:01:02:49 (15) in Meade County.

Motion by Shoener, seconded by Spies, to approve the proposed recommended changes. Motion carried (all ayes).

Resolution Number 2009-7.01 was approved

Bill Nevin, Legal Counsel, presented to the Commission the approval of one backup prequalification committee member. Tom Gilsrud for Hadly Eisenbeisz in the event that Hadly is unavailable.

Motion by Tidball, seconded by Gregerson, to approve Gilsrud as an alternate for the prequalification committee. Motion carried (all ayes).

Secretary Bergquist discussed the next Legislative Summer Study and Sunset Review of Highway Needs Study August 19 & 20. Invitations have been sent out to individuals who interact with the Department to participate in a public comment period on the afternoon of the 19th during the Sunset Review Study.
Secretary Bergquist advised the Department is halfway through the STIP hearings. They are going well, but attendance is down from last year.
Secretary Bergquist discussed the Federal Funding issue. Congress needs to enact at least a short-term fix in order to keep the federal Highway Trust Fund solvent through the end of SAFETEA-LU. The only version of proposed legislation for future highway funding is unfavorable to SD and other rural states. South Dakota is supporting a potential 18 month extension to the existing program, but additional funding will need to be found in order to continue the program at its existing level.
On August 10, 2009, Senator Thune will be hosting a Congressional field hearing in Sioux Falls regarding transportation issues in rural states and Secretary Bergquist has been invited to testify at the hearing.

Secretary Bergquist discussed Stimulus Transportation Enhancement applications.
We used other federal enhancement funds for the Days of 76 Museum in Deadwood and with that money added three additional stimulus enhancement projects.
Motion by Tidball, seconded by Spies, to change funding for the Days of 76 Museum and add three additional stimulus projects. Motion carried (all ayes).

Joel Jundt, Director of Planning and Engineering, presented the following right-of-way items for Commission consideration:

1. Dispose of Excess Property – Yankton County
Request approval to dispose of the following property: Lots 5 and 6, Block 1 of
Witherspoon’s and Todd’s Addition, City and County of Yankton, South Dakota.
(Appraised value: $42,000).

The above property contains 13,200 sq. ft. purchased in 2004 for the Missouri River Bridge Project BRF 0081(45)0. Location is 111 Broadway Avenue in Yankton and includes a small 1 1/2 story house. A Restrictive Covenant and Declaration of Preservation Restrictions prevents’ removal of the house until 2016. Zoning is B-3 Central Business. Yankton Area Office advises the property is not needed for future department use. (see attached).

2. Dispose of Excess Property – Yankton County
Request approval to dispose of the following property: Lot D and Lot 4, Block 1,
Witherspoon’s Addition, City and County of Yankton, South Dakota. (Appraised
value: $43,200).

The above property contains 13,146 sq. ft. purchased in 2004 for the Missouri River Bridge Project BRF 0081(45)0. Location is 101 Broadway Avenue in Yankton and includes a two story house. A Restrictive Covenant and Declaration of Preservation Restrictions prevents’ removal of the house until 2014. Zoning is B-3 Central Business. Yankton Area Office advises the property is not needed for future department use. (see attached).

Motion by Shoener, seconded by Tidball, to approve dispose of excess properties in Yankton County. Motion carried (all ayes).

3. Vacate Plat – Lincoln County
This resolution will vacate the plat for Parcel 28 on Project P 0100(101)405, PCN
00T7 – Lot H1 in the SW1/4 SE1/4 of Section 14, Township 100 North, Range 50
West, 5th P.M., Lincoln County, South Dakota.

This property was sub-divided and sold to another owner after the state had acquired it, making this plat incorrect. A correct plat has been prepared.

Motion by Tidball, seconded by Spies, to approve vacate plat in Lincoln County. Motion carried (all ayes).

The Nomination Committee of Commissioners Shoener and Fouberg nominated Jim Spies as Chairman and Sam Tidball as Co-Chairman for a one-year term. Motion by Shoener, seconded by Trucano. Motion carried (all ayes).

Chairman Marquardt thanked the Commission and DOT employees for his one-year term. He enjoyed serving as Chairman.

Commissioner Gregerson brought up discussion on changing the speed limit on South Minnesota. There is a lot of landscaping at this intersection and visibility is poor. Constituents would like the speed limit to increase before this point rather than at it. Greg Fuller will look into this and report back to the Commission.

Motion by Spies, seconded by Tidball, for the Commission to go into Executive Session. The Commission went into Executive Session at 10:03 a.m. for the purpose of discussing a pending legal case."

The Commission reconvened into Regular Session at 10:20 a.m.

There being no further business, at the hour of 10:20 a.m. the Transportation Commission adjourned.
