Chairman Spies called the meeting to order at 9:30 a.m.

Roll call was taken.

Motion by Marquardt, seconded by Fouberg, to approve the August 27, 2009, Commission Meeting Minutes. Motion carried (all ayes).

Dean VanDeWiele, Engineering Supervisor, Project Development, presented bids from the August 19 and September 2, 2009 bid lettings.

Motion by Fouberg, seconded by Spies, to award projects 1, 2, & 3 to the low bidder subject to approval of required concurrences and necessary good faith documentation. Motion carried (all ayes).

Project 4 was withdrawn and has an anticipated letting date of Oct 7, 2009.

Joel Jundt, Director of Planning & Engineering, presented the 2009-2013 Statewide Transportation Improvement Program Revision 09-033 to the Commission for their approval.

Motion by Shoener, seconded by Trucano, to approve the 2009-20013 Statewide Transportation Improvement Program Revisions 09-033. Motion carried (all ayes).

Bill Nevin, Legal Counsel, updated the Commission on the DM&E project. A motion has been filed to suspend proceedings and have the Transportation Commission re-open the administrative hearing for additional evidence concerning the Canadian Pacific's intention not to construct the PRB project at this time.

Motion by Shoener, seconded by Marquardt, to authorize Bill Nevin to file a response resisting the motion because the proposed additional evidence addresses a matter that is beyond the scope of the hearing and has no effect on the decision the Transportation Commission made. Motion carried (6 ayes, 1 nay, and 1 abstained).

There being no further business, at the hour of 10:02 a.m. the conference call for the Transportation Commission adjourned.
