Chairman Spies called the meeting to order at 8:58 a.m.
Motion by Tidball, seconded by Shoener, to approve the September 3, 2009, Conference Call Meeting Minutes. Motion carried (all ayes).

Secretary Darin Bergquist updated the Commission on the ongoing Legislative Agency Review and Highway Needs summer studies. Both studies are going well with final meetings to be held October 13-14, 2009. The primary topic remaining for the Agency Review portion of the study is the review and recommendations for updating, clarifying, and any necessary changes for statutes impacting the Department. At the conclusion of the last Highway Needs study, the committee seemed to accept that significant highway funding needs existing and began discussions regarding possible sources of additional revenue. At its last meeting, the Committee will finalize the adoption of specific recommendations to make to the Legislative Executive Board.
Secretary Darin Bergquist reported that with SAFETEA-LU set to expire on September 30th, the House had passed legislation yesterday extending the existing program by 90 days. The extension passed by the House is now needs to be considered and passed by the Senate prior to the September 30th expiration.

Greg Fuller, Director of Operations, presented to the Commission a list of the named highway designations and the current Naming Highways policy.
Greg Fuller, Director of Operations, presented to the Commission a sign proposal for the Chad Mechels Memorial Highway.
Motion by Shoener, seconded by Tidball to approve the Chad Mechels Memorial Highway sign with dimensions 2’ x 5’ and with text all in capital letters, but defer action of placement of the sign until the trial has been completed. Motion carried (all ayes).

Greg Fuller, Director of Operations, presented to the Commission consideration of closure of three segments of highway right-of-way to the use of off road ATV’s in the Sioux Falls Area; along SD 11 from MRM 90.3 to MRM 94.4, along SD 17 from MRM 42.05 to MRM 55.8, and along SD 115 from MRM 89.4 to MRM 107.4.
Motion by Marquardt, seconded by Gregerson, to approve closure of these three segments of highway right-of-way to the use of ATV’s due to significant damage in the Sioux Falls Area. Motion carried (all ayes).

Todd Seaman, Rapid City Region Engineer, presented to the Commission changes in Access Control along US85 at Exit 10.
Motion by Tidball, seconded by Shoener, to approve relinquishment of changes in Access Control along US85 at Exit 10. Motion carried (all ayes).

Joel Gengler, Right of Way Program Manager, presented the following right-of-way items for Commission consideration:
1. Dispose of Excess Property – Davison County
Request approval to dispose of the following property: Lots 1-6 of
Block 13, Railroad Addition to the City of Mitchell, Davison County,
South Dakota. (Appraised value - $45,500).
The above property contains 0.70 acre located in Mitchell on the west
side of Sanborn Boulevard between Ash and Birch Streets. Property is
excess from highway project BRF 0037(40)74 and zoned Highway
Business. Mitchell Area advises the property is no longer needed for
future DOT use. (see attached).
2. Dispose of Excess Property – Hughes County
Request approval to dispose of the following property: Lot “R” of
Outlot 1 of Cunningham’s Outlots in the E1/2 SW1/4 of Section 2,
Township 110 North, Range 79 West, Hughes County, South Dakota.
(Appraised value - $25,800).
The above property contains 2.58 acres purchased in 1975 for the South
Dakota Division of Criminal Investigation storage facilities. Location is
along Highway 34 east of Pierre near the National Guard Armory. A
City/County utility easement serving the new jail facility covers the
west half of the property. Zoning is industrial. DCI no longer uses the
property and the Pierre Area advises the property is not needed for
future DOT use. (see attached).
Motion by Shoener, seconded by Fouberg, to accept the offer to dispose of excess property in Davison and Hughes County. Motion carried (all ayes).
3. Dispose of Excess Property – Yankton County
Request approval to dispose of the following property: Lot D
and Lot 4, Block 1 of Witherspoon’s and Todd’s Addition, City and
County of Yankton, South Dakota. (Appraised value: $43,200. 80% of
appraisal: $34,560).
The above property is located at 101 Broadway Avenue in Yankton and
contains 13,146 sq. ft. with a two-story house built in 1910. Yankton
Area advises the property is no longer needed after the bridge project
completion.
The Commission previously approved the property disposal and a
public auction was held on August 12, 2009 without receiving the
appraised value bid. A sale for 80% or more of the appraisal is allowed
under Administrative Rule 10:02:01:07 and a qualifying amount offer is
anticipated. This Commission approval would allow private
negotiations to sell the property without further advertising or offer for
sale.
4. Dispose of Excess Property – Yankton County
Request approval to dispose of the following property: Lot 3 and the
West 12’ of Lot 4 except the North 95’ thereof, Block 2, Todd’s
Addition, City and County of Yankton, South Dakota, less Lot H1.
(Appraised value: $52,000. 80% of appraisal: $41,600).
The above property is located at 100 Broadway Avenue in Yankton and
contains 5,219 sq. ft. with a home built in 1947. Yankton Area advises
the property is no longer needed after the bridge project completion.
The Commission previously approved the property disposal and a
public auction was held on July 15, 2009 without receiving the
appraised value bid. A sale for 80% or more of the appraisal is allowed
under Administrative Rule 10:02:01:07 and a qualifying amount has
been offered. This Commission approval would allow private
negotiations to sell the property without further advertising or offer for
sale.
Motion by Tidball, seconded by Kranz, to accept the offer to dispose of excess properties in Yankton County. Motion carried (all ayes).

Motion by Tidball, seconded by Marquardt, for the Commission to go into Executive Session. The Commission went into Executive Session at 10:29 a.m. to discuss pending litigation.
The Commission reconvened into Regular Session at 11:30 a.m.
