For each state transportation construction project involving funds of $100,000 or more, and those involving federal funds in excess of $2,000, the Department assumes responsibility for the enforcement of and compliance with the following federal labor provisions:
- Employees are entitled to no less than the prevailing South Dakota Department of Transportation wage rate for the classification of work they actually perform, no matter how skilled they are, or how long they do it.
- Employers may not deduct wages from an employee's pay check that the employee does not approve, except taxes and legal garnishments or attachments.
- Employees are entitled to receive overtime 1.5 times, no less, than the required minimum wage for each hour over 40 hours they work during the same work week for the same contractor.
- Employees are entitled to be paid in full for each week's work, no later than seven days after the last day of each work week.
- Employees are entitled to file a wage/hour complaint against their employer without fear of retaliation.
